Bowman ORDINANCE NO. 9616 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED AT 7249 EAST BRAINERD ROAD, BEING ON THE NORTHEAST LINE OF EAST BRAINERD ROAD NORTHWEST OF GUNBARREL ROAD FROM R-4 SPECIAL ZONE TO C-2 CONVENIENCE COMMERCIAL ZONE, SUBJECT TO CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located at 7249 East Brainerd Road, being on the northeast line of East Brainerd Road northwest of Gunbarrel Road. Lots 2 and 3, and part of lot 1, Hamilton Village Subdivision, as shown by plat of record in plat book 41, page 384, R.O.H.C. Said lots and part of lot form one tract beginning on the northeast line of East Brainerd Road 680 feet northwest of the intersection of the northeast line of East Brainerd Road with the northwest line of Gunbarrel Road, thence northwest 347.43 feet with East Brainerd Road, thence northeast some 203 feet, thence southeast 316.5 feet, thence southwest some 242 feet to the northeast line of East Brainerd Road, the point of beginning. Said lots and part of lot being the properties described in deed book 3245, page 174, R.O.H.C., and deed book 3628, page 466, R.O.H.C., and part of the property described in deed book 3402, page 984, R.O.H.C. Tax Map No. 158E-C-8.1 and 8.2, and part of 158E-C-8. from R-4 Special Zone to C-2 Convenience Commercial Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Erection and maintenance of a sight-obscuring screen and landscaping abutting all residential zones. 2. Approval of site plan of building location relative to Concord Apartments by City Traffic Engineer. 2. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it.
